LucusAI Terms of Service

These Terms of Service ("Terms") govern your access to and use of LucusAI, including the website, application, AI character services, subscriptions, and related services (collectively, the "Service").

LucusAI is operated from Tamil Nadu, India ("LucusAI", "we", "us", or "our").

By creating an account, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use LucusAI.

1. Eligibility

You must be 18 years of age or older to use LucusAI.

By using the Service, you confirm that you are legally capable of entering into these Terms and that the information associated with your account is accurate.

LucusAI is not intended for persons under 18.

2. The LucusAI Service

LucusAI allows users to create private AI characters and interact with those characters through AI-generated conversations.

Characters may be based on fictional concepts, existing fictional characters, public figures, real people, or other concepts provided by users. LucusAI does not represent that any character is a real person or that an AI character is actually communicating with the person it may resemble.

AI-generated responses may be inaccurate, incomplete, inappropriate, offensive, or inconsistent. AI characters may make statements that are fictional or factually incorrect.

The Service is an AI entertainment and conversational product. AI characters are not substitutes for doctors, lawyers, financial advisers, therapists, emergency services, or other qualified professionals.

Do not rely on LucusAI for medical, legal, financial, emergency, or other high-stakes decisions.

3. Accounts and Google Sign-In

You create a LucusAI account using Google Sign-In.

You are responsible for maintaining the security of your Google account and for activity occurring through your LucusAI account.

You must not:

access another person's account;
attempt to obtain another user's account information;
share or misuse authentication credentials;
circumvent account restrictions;
create accounts for fraudulent or abusive purposes.

We may suspend or terminate accounts that violate these Terms or applicable law.

4. Characters and User Content

You may create characters, character descriptions, personalities, prompts, conversations, and avatar images ("User Content").

As between you and LucusAI, you retain ownership of the rights you have in your User Content.

You grant LucusAI a limited, non-exclusive license to host, store, reproduce, process, transmit, and display User Content as reasonably necessary to operate, maintain, secure, and provide the Service.

This license ends when the relevant User Content is deleted, except where retention is required by law or reasonably necessary for legal claims, security, fraud prevention, or enforcement.

LucusAI does not grant you ownership of third-party intellectual property. If you create a character based on a copyrighted fictional character, trademark, public figure, or real person, you are responsible for ensuring that your use does not violate applicable rights or laws.

You must not use LucusAI to impersonate another person for fraud, deception, harassment, or other unlawful purposes.

5. AI-Generated Content

LucusAI uses third-party AI services, currently Google's Gemini API, to generate responses.

AI output is generated automatically and may be similar to content generated for other users. LucusAI does not guarantee that AI output is accurate, unique, suitable, or legally protectable.

You are responsible for how you use AI-generated output.

Unless we expressly permit otherwise in writing, LucusAI is provided for personal, non-commercial use. You may not use LucusAI to operate a competing service, resell access to the Service, or provide a paid service primarily based on LucusAI's functionality or access.

6. Prohibited Uses

You must not use LucusAI to:

create, request, distribute, or facilitate sexual content involving minors;
create or facilitate non-consensual sexual content;
facilitate serious criminal activity;
facilitate terrorism or terrorist activity;
facilitate fraud, scams, or deceptive schemes;
facilitate self-harm or suicide;
facilitate illegal drug activity;
create or facilitate extreme violent wrongdoing;
produce or distribute unlawful hate content;
infringe intellectual-property, privacy, publicity, or other legal rights;
harass, threaten, stalk, or abuse others;
attempt to bypass, disable, manipulate, or evade LucusAI's safety systems;
interfere with or disrupt the Service;
reverse engineer or attempt to extract underlying models, prompts, safety mechanisms, or source code except where applicable law expressly permits it;
use automated methods to abuse, overload, scrape, or access the Service without authorization; or
use the Service in violation of applicable law.

Discussion or fictional references to sensitive subjects may sometimes be permitted, but LucusAI's automated safety systems may restrict or block content depending on the request and context.

7. Safety Moderation

LucusAI uses automated safety and moderation systems to identify and restrict certain harmful requests or outputs.

A message may be blocked if it violates LucusAI's safety requirements.

If a message is blocked, LucusAI may display a general warning or refusal rather than providing the requested content.

We may also suspend or terminate accounts that repeatedly attempt to circumvent safety controls.

LucusAI does not guarantee that automated moderation will identify every prohibited request or output.

8. Private Characters and Conversations

Characters and conversations created through LucusAI are intended to remain private to the account that created them.

LucusAI does not provide a public character marketplace or public character profiles.

You are responsible for the information you choose to place into character definitions and conversations.

Do not submit passwords, financial-account credentials, government identification numbers, highly sensitive personal information, or other information you would not want processed by an AI service.

9. Subscription and Payment

Certain LucusAI functionality requires a paid subscription.

Subscriptions are processed through Razorpay. LucusAI does not store your full card details.

Your subscription provides access to the functionality described at the time of purchase, including the ability to create characters and chat with them.

Subscriptions automatically renew according to the billing period selected at purchase unless cancelled before the next renewal.

You may cancel your subscription through the available cancellation controls on the website.

After cancellation, your subscription remains active until the end of the already-paid billing period. Cancellation prevents future automatic renewal.

If a payment fails, or your subscription expires without renewal, access to the chat area will be disabled. The chat area contains the Service's character-chat functionality, so you will not be able to enter existing chat pages or use their functionality while your subscription is inactive.

Your underlying account and stored data may remain in our database unless you request account deletion.

10. Refunds

Subscription payments are generally non-refundable.

However, nothing in these Terms excludes any refund, remedy, or consumer right that cannot legally be excluded under applicable law.

11. Payment Information

Razorpay processes payments on our behalf.

LucusAI may receive and store payment-related information such as:

Razorpay customer ID;
payment ID;
subscription ID;
transaction amount; and
payment status.

LucusAI does not store your full card number or other complete payment credentials.

12. Deletion of Characters and Conversations

You may delete individual characters and conversations through the Service where those controls are provided.

When you delete a character, the associated character data and conversations are deleted from our database.

When you delete a conversation, it is permanently deleted from our database.

LucusAI currently does not maintain backups of deleted conversations or characters.

You may request complete account deletion by emailing:

When we complete an account-deletion request, we intend to delete the account and associated stored data, subject to information that we are legally required to retain or reasonably need to retain for legal claims, fraud prevention, security, or compliance.

13. Suspension and Termination

We may immediately suspend or terminate your account if we reasonably believe that you:

violated these Terms;
violated applicable law;
attempted to circumvent safety controls;
engaged in fraud or abuse;
interfered with the Service;
created a security risk;
misused another person's rights or information; or
created a significant risk to LucusAI, other users, or third parties.

We may permanently prevent a terminated user from creating another LucusAI account.

You may terminate your account at any time by contacting us at:

Termination does not automatically entitle you to a refund.

14. Service Changes and Availability

We may modify, suspend, replace, or discontinue any part of LucusAI at any time.

We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with every device or environment.

AI models, model versions, features, pricing, limits, and third-party services may change over time.

We may replace or upgrade the AI models used by LucusAI without prior notice where reasonably necessary to operate or improve the Service.

15. Third-Party Services

LucusAI depends on third-party services, including Google, AWS, MongoDB, and Razorpay.

Third-party services may have their own terms, policies, availability limitations, and processing practices.

We are not responsible for failures or changes in third-party services outside our reasonable control.

16. Intellectual Property

The LucusAI website, software, branding, interface, original text, design, and other materials provided by LucusAI are owned by or licensed to us and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, sublicense, or commercially exploit LucusAI or its proprietary components.

17. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

WE DO NOT GUARANTEE THAT:

AI RESPONSES WILL BE ACCURATE OR COMPLETE;
AI RESPONSES WILL BE APPROPRIATE FOR YOUR PURPOSE;
THE SERVICE WILL ALWAYS BE AVAILABLE;
THE SERVICE WILL BE ERROR-FREE OR SECURE; OR
ANY PARTICULAR CHARACTER OR AI OUTPUT WILL BE AVAILABLE FOR ANY PARTICULAR PERIOD.

AI CHARACTERS ARE NOT REAL PEOPLE AND SHOULD NOT BE TREATED AS SUCH.

DO NOT USE LUCUSAI AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL, LEGAL, FINANCIAL, MENTAL-HEALTH, EMERGENCY, OR OTHER PROFESSIONAL SERVICES.

18. Limitation of Liability

To the maximum extent permitted by applicable law, LucusAI and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or relating to the Service.

To the maximum extent permitted by applicable law, our total aggregate liability arising from your use of the Service will not exceed the amount you paid to LucusAI for the Service during the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

19. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless LucusAI and its operator from claims, losses, liabilities, damages, costs, and expenses arising from:

your violation of these Terms;
your User Content;
your unlawful use of the Service;
your infringement of another person's rights; or
your misuse of AI-generated content.

20. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles.

Subject to any mandatory consumer or other legal rights that cannot be waived, disputes relating to the Service will be subject to the jurisdiction of the courts having jurisdiction in Tamil Nadu, India.

Before commencing formal legal proceedings, the parties should make a reasonable attempt to resolve the dispute by contacting:

Nothing in this section prevents a party from seeking urgent legal relief where necessary.

21. Changes to These Terms

We may update these Terms when the Service, law, or our practices change.

The updated version will be posted on the LucusAI website with a revised effective date.

Your continued use of LucusAI after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
